Chemically speaking, both Delta-8 THC and Delta-9 THC are remarkably similar. The most significant difference is that the double bond is in a different position, hence Delta-8 and Delta-9. The number refers to where the double bond is located on the strand. Delta-8 THC interacts with both the CB1 and CB2 receptors in the Endocannabinoid System (ECS) and has psychotropic properties, but the high is much milder.

Many people that have used Delta-8 THC have rated it at about half as strong as regular THC. The easiest way to imagine Delta-8 THC is to think of it as the light beer of the cannabis world.

Delta-8 THC is found naturally in both hemp and marijuana flower, but only in ridiculously small concentrations, usually less than 1%. To achieve higher yields of Delta-8 THC, cultivators can produce Delta-8 THC from both Delta-9 THC and also cannabidiol (CBD). If the Delta-8 THC is produced from CBD sourced from hemp, then technically, under the 2018 US Farm Bill, it’s legal at a federal level.

Scientists and researchers have been investigating Delta-8 THC since the early 1980s, with the cannabinoid showing a lot of potential as a replacement to Delta-9 THC. One of the biggest drawbacks to using cannabis products high in Delta-9 THC is the psychotropic effects of the cannabinoid. Delta-8 THC has the potential to offer the same therapeutic benefits without the negative side-effects. Still, more research and clinical trials are needed before we can make any definitive medical claims about the cannabinoid.  

Not everyone reacts well to Delta-9 THC, with many users reporting feeling anxious, paranoid, nauseous, sluggish, and tired. The side-effects of Delta-9 THC only get worse as you start using more potent marijuana products.

Is Delta-8 THC Legal?

Currently, the 2018 US Farm Bill makes it legal at a federal level to cultivate hemp and produce goods from hemp, as long as the Delta-9 THC content is lower than 0.3%. Delta-8 THC is most commonly produced from CBD that has been sourced from hemp plants, so technically, it’s 100% legal in any state where CBD products are legal. While the DEA is currently investigating the classification of all cannabinoids, they are not commenting on whether or not Delta-8 THC is legal. Still, companies across the United States are embracing the cannabinoid in record numbers.
